What happens if a living trust was never funded?

If no property was ever made subject to the trust, there may be nothing for its trustee to administer yet. In Michigan, a signed instrument is not invalid just because no property was transferred at signing, but the nominated trustee generally has no duties under it until property is transferred or made subject to it, unless specifically agreed otherwise. Check what was actually funded

Michigan permits both a transfer to a trustee and an owner's declaration that identifiable property is held as trustee. Ask an attorney to review the signed document and ownership records before treating an asset as outside the trust. MCL 700.7401(1)(a)-(b)

Use the trust funding checklist to gather deeds, account records and beneficiary forms for that review.

Do not assume a probate result

Michigan also recognizes certain transfers on death in account agreements, insurance policies and other written instruments as nontestamentary, meaning they are not transfers by will. Review beneficiary designations separately; the trust's funding status alone does not decide how each asset passes. This is a Michigan example, not a promise about every state or asset. MCL 700.6101(1)

Continue with trust mistakes after signing. Bring unresolved ownership and transfer questions to an attorney in the state whose law applies.
